Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Wall Media Group LLC ("Company," "we," "us," or "our") governing your use of the GameNight mobile application and website (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years of age to use GameNight. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Your Account

To use certain features of GameNight, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Service

GameNight allows you to discover games by swiping, connect with friends, find games to play together via Party Up, earn XP, maintain streaks, level up, unlock achievements, and optionally import your Steam library.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Harass, abuse, or harm other users.
• Impersonate any person or entity, or falsely claim an affiliation.
• Attempt to gain unauthorized access to the Service or its systems.
• Use bots, scrapers, or automated tools to interact with the Service.
• Manipulate XP, streaks, levels, or achievements through exploits or unauthorized means.
• Interfere with or disrupt the Service or servers connected to the Service.

5. Gamification & Virtual Items

GameNight includes gamification features such as XP, levels, streaks, achievements, and weekly challenges. These features are provided for entertainment purposes only. They have no monetary value and cannot be exchanged, sold, or transferred. We reserve the right to modify, reset, or remove gamification features at any time.

6. Steam Integration

If you choose to link your Steam account, you authorize us to access your public game library and playtime data through the Steam Web API. Your use of Steam is subject to Valve Corporation's terms of service. We are not affiliated with, endorsed by, or sponsored by Valve Corporation.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Wall Media Group LLC and are protected by copyright, trademark, and other intellectual property laws. The GameNight name, logo, and branding are trademarks of Wall Media Group LLC.

Game titles, images, descriptions, and related media displayed within the Service are the property of their respective owners and publishers.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WALL MEDIA GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

10. Apple App Store Terms

If you access GameNight through the Apple App Store, the following additional terms apply:

• This agreement is between you and Wall Media Group LLC, not Apple Inc. ("Apple").
• Wall Media Group LLC, not Apple, is solely responsible for the GameNight app and its content.
• Apple has no obligation to provide any maintenance or support services for GameNight.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app.
• Wall Media Group LLC, not Apple, is responsible for addressing any claims relating to the app or your possession and use of the app.
• In the event of any third-party claim that the app infringes a third party's intellectual property rights, Wall Media Group LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through the app settings or by visiting our Account Deletion page.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
